Administrative measures for construction qualification of cultural relics protection projects (for Trial Implementation)

In the past five years, professionals who have won national, provincial and ministerial awards for the construction of cultural relics protection projects or related scientific research projects due to project quality, management innovation and scientific and technological innovation and who apply to be the responsible engineer of cultural relics protection projects may appropriately relax the standards in (2) and (3) of the preceding paragraph.

The National Association of cultural relics protection industry shall issue the certificate of responsible engineer of cultural relics protection project to the personnel who pass the examination, and publish the list to the society and report to the State Administration of cultural relics for the record.

The qualified personnel shall be issued with the certificate of construction technicians of cultural relics protection projects by the National Cultural Relics Protection Industry Association published by the State Administration of cultural relics.

Article 16 The competent department of cultural relics at the provincial level may decide to exempt from examination the old craftsmen who have been engaged in the construction of cultural relics protection projects for a long time in their own areas, have mastered the traditional technology, have been trained by the professionals of cultural relics protection projects, and are over 50 years old.

The training contents of construction professionals of cultural relics protection projects shall include relevant professional knowledge such as laws and regulations, protection principles, standards and specifications of cultural relics protection, and the training time shall not be less than 40 hours.

1、 Article 1 These measures are formulated in accordance with the relevant provisions of the law of the people’s Republic of China on the protection of cultural relics, the regulations for the implementation of the law of the people’s Republic of China on the protection of cultural relics, and the administrative measures for the protection of cultural relics in order to strengthen the management of construction qualification of cultural relics protection projects.

The responsible engineer shall not be responsible for the management of the construction of two or more cultural relics protection projects at the same time.

2、 Professionals Article 7 professionals in the construction of cultural relics protection projects refer to professionals who have received relevant training in the construction of cultural relics protection projects, passed the examination, and obtained certificates of corresponding categories and scope of work.

The responsible engineer shall be fully responsible for the on-site organization management and quality control of the construction of the cultural relics protection project, and shall be directly responsible for the safety of cultural relics and the quality of the project.

The provincial competent department of cultural relics is responsible for the annual inspection and daily management of the construction qualification of cultural relics protection projects.

Article 12 the responsible engineer of cultural relics protection project shall meet the following requirements: (1) be familiar with the laws and regulations on cultural relics protection, have a strong sense of cultural relics protection, and follow the basic principles, scientific concepts, industrial norms and professional ethics of cultural relics protection.

Article 4 the construction qualification level of cultural relics protection projects is divided into grade I, grade II and grade III.

Article 9 the construction technical personnel of cultural relics protection projects include technical personnel of various professional types of work, documenters, safety officers, etc.

Article 14 The competent department of cultural relics at the provincial level shall be responsible for organizing the training and continuing education of professionals engaged in the construction of cultural relics protection projects.

Article 15 the responsible engineers of cultural relics protection projects shall be examined by the national cultural relics protection industry association.

Article 3 the construction units of cultural relics protection projects shall apply for qualification and business scope in accordance with the provisions of these measures, and after obtaining the qualification certificates of corresponding levels, they shall engage in the construction activities of cultural relics protection projects within the permitted business scope.

Construction professionals of cultural relics protection projects shall not be employed by two or more cultural relics protection project qualification units at the same time.

The provincial competent department of cultural relics or the professional institution entrusted by it shall be responsible for organizing the assessment of the construction technicians of cultural relics protection projects.

Article 6 the business scope of the construction qualification of cultural relics protection projects is divided into five categories: ancient cultural sites, ancient tombs, ancient buildings, grotto temples and stone carvings, important modern historical sites and representative buildings, murals, etc.

Article 10 technical personnel for the construction of cultural relics protection projects shall participate in the professional technical work related to the construction of cultural relics protection projects for more than 3 years, or have junior technical positions in the relevant disciplines of cultural relics protection projects.
