Chapter III Safety Responsibility Article 14 The main responsible person shall be fully responsible for the safety production work of the enterprise, and shall establish and improve the safety production management system of the enterprise, set up a safety production management organization, allocate full-time safety production management personnel, ensure the investment in safety production, supervise and inspect the safety production work of the enterprise, eliminate the hidden dangers of safety accidents in time, and implement the safety production responsibility.
Article 13 “Safety management personnel” shall not alter, resell, lease, lend or illegally transfer the certificate of safety production assessment in any other form.
The inspection results shall be recorded in the enterprise and project safety management archives.

Article 7 The assessment of production safety includes the assessment of production safety knowledge and management ability.
Article 12 If the “safety management personnel” lose the safety production assessment certificate, they shall declare it invalid in the public media, and apply to the original assessment authority for reissue through their employed enterprises.
Article 4 The competent department of housing and urban and rural construction under the State Council is responsible for the supervision and management of the work safety of the national “safety management personnel”.
The project leader refers to the person who has obtained the corresponding registered practice qualification and is authorized by the legal representative of the enterprise to be responsible for the specific project management.
Full-time safety production management personnel refer to the personnel engaged in safety production management in the enterprise, including the personnel of the enterprise safety production management organization and the personnel engaged in safety production management in the project.
Article 3 The main responsible person of an enterprise refers to the leading person who has decision-making power over the production and operation activities and work safety of the enterprise.

Chapter II Assessment and Certificate Issuance Article 5 “Safety management personnel” shall apply for safety production assessment to the competent housing and urban and rural construction department of the people’s government of the province, autonomous region and municipality directly under the Central Government (hereinafter referred to as the assessment authority) where the enterprise is registered for industry and commerce through its employed enterprise, and obtain the safety production assessment certificate.
The format of the certificate shall be uniformly prescribed by the competent department of housing and urban and rural construction under the State Council.
If it is found that the person in charge of the project fails to perform his duties properly, it shall be ordered to make corrections; Adjust the project leader if necessary.
Article 2 The “safety management personnel” of construction enterprises engaged in the construction of housing construction and municipal infrastructure projects within the territory of the People’s Republic of China shall participate in the assessment of production safety, perform the responsibility of production safety, and implement the supervision and management of production safety.
Article 16 The main person-in-charge shall inspect the engineering projects undertaken by the enterprise according to the regulations, and assess the project person-in-charge’s safety production management ability.
Article 6 The “safety management personnel” who apply to participate in the assessment of production safety shall have the corresponding education level, professional and technical titles and certain work experience of production safety, establish labor relations with the enterprise, and pass the annual education and training of production safety of the enterprise.
No fee shall be charged for safety production assessment.

For those who have not been subject to administrative punishment due to production safety accidents or violation of this regulation within the validity period of the certificate, have not recorded any bad behavior in the credit file, and have participated in the safety production education and training organized by the enterprise and the competent housing and urban and rural construction department of the people’s government at or above the county level according to the regulations, the assessment authority shall grant the certificate extension within 20 working days from the date of accepting the extension application.
The competent departments of housing and urban and rural construction of the local people’s governments at or above the county level are responsible for the supervision and management of the work safety of “safety management personnel” in their administrative areas.
Article 10 If the validity of the production safety assessment certificate needs to be extended, the “safety management personnel” shall apply for the extension of the certificate to the original assessment authority through the employed enterprise within 3 months before the expiration of the validity period.
Article 15 The main person-in-charge shall sign a safety production responsibility letter with the project person-in-charge to determine the project safety production assessment objectives, rewards and punishment measures, as well as the safety management and technical guarantee measures provided by the enterprise for the project.
The assessment organ shall complete the procedures within 5 working days from the date of accepting the application.
If the renewal of the certificate is granted, the validity of the certificate shall be extended for 3 years.
Article 8 For those who pass the production safety assessment, the assessment authority shall issue the certificate of production safety assessment within 20 working days and make an announcement; For those who are unqualified, they shall notify them through the enterprise of the “safety management personnel” and explain the reasons.
Article 11 If the “safety management personnel” change the employed enterprise, they shall terminate the labor relationship with the original employing enterprise, and apply to the assessment authority for certificate change through the newly employed enterprise.

The assessment content of safety production knowledge includes: laws and regulations, rules and regulations, standards and specifications of construction safety, basic theories of construction safety management, etc.
