Article 2 [scope of application] These measures are applicable to the housing construction and municipal infrastructure projects in the administrative region of the province that should obtain the construction license according to law
.
Article 3 the principle of management shall be based on the principle of localized management, hierarchical responsibility and responsibility of the person in charge
.
Article 4 [real name system management] the real name system management as mentioned in these Measures refers to the system that takes the real name system management information system (Heilongjiang construction site information management platform) as the carrier, collects the basic information, employment records, credit records and other information of the construction site personnel, implements the enterprise responsibility, and carries out the information management of the construction site enterprises and personnel
.
Article 5 [enterprises and personnel] the construction employment enterprises mentioned in these Measures refer to the contracting enterprises and construction labor service enterprises that directly use their own construction workers (migrant workers)
.
General contracting enterprises refer to general engineering contracting enterprises, general construction contracting enterprises and professional contracting enterprises that directly contract construction projects
.
Construction site personnel refer to construction workers (migrant workers) and construction management personnel
.
Construction management personnel include project director, technical director, quality director, safety director, chief supervision engineer or director representative, professional supervision engineer, etc
.
Chapter two Management responsibilities Article 6 [division of Responsibilities] The Department of housing and urban rural development of Heilongjiang Province is responsible for guiding and supervising the real name system management of housing construction and municipal engineering projects within the administrative region of Heilongjiang Province
.
The municipal housing and urban rural development bureaus are responsible for guiding and supervising the real name system management in their respective administrative regions, and carrying out daily supervision and inspection on the real name system management of construction enterprises and construction site personnel in their respective administrative regions
.
Article 7 [Responsibilities of participating units] the construction unit is responsible for coordinating, supervising and inspecting the implementation of various regulations and measures of real name system management of engineering projects by general contracting enterprises and supervision enterprises
.
The general contracting enterprise shall be responsible for the real name management of the projects it undertakes
.
Responsible for the configuration of real name system management related hardware facilities; Responsible for the registration of the real name system information of the construction site personnel, and timely upload the relevant information of the construction site personnel to the construction site information management platform (hereinafter referred to as the platform), and responsible for the authenticity and accuracy of the uploaded information
.
Construction enterprises should implement the real name management responsibility, be responsible for the collection and verification of the construction site personnel information, and be responsible for the authenticity and accuracy of the collected information
.
Chapter three Management requirements Article 8 [real name system for migrant workers] fully implement the management system of real name system for migrant workers
.
The construction site should set up access control attendance equipment, adopt biometric technology such as face and iris to manage migrant workers’ work attendance, and upload data to the platform in real time
.
If the project does not have closed management, the two-dimensional code attendance mode can be used
.
Article 9 the construction management personnel shall bind the platform before the supervision unit issues the commencement order
.
After the commencement of the project, the attendance of the platform shall be applied every day, and the staffing shall be in strict accordance with the commitment of the bidding document
.
The project management personnel without attendance record shall be deemed not to perform their duties
.
Construction industry workers (migrant workers) can enter the site only after real name registration, and carry out attendance on the platform
.
Attendance records are used as one of the basis for obtaining wages
.
Article 10 [special account] the special account system for wages of migrant workers shall be fully implemented
.
Construction general contracting enterprises open special accounts for migrant workers’ wages in banks, and bind special accounts through the platform
.
The enterprise can open a special account in the bank, and the platform creates a secondary sub special account for each project under construction
.
Article 11 [issued by the bank] The general contractor shall entrust the bank to pay wages to migrant workers directly through the special account
.
In the current month, the wage payment of labor service personnel in the previous month should be completed through the platform, and the wage payment of temporary workers less than one month should also be included in the platform
.
Within five days from the end of employment, the employer should pay the wages through the platform at one time
.
Article 12 [pay salary in full by month] separate management of labor cost and project payment shall be implemented
.
The construction unit shall timely and fully allocate the labor cost in the project funds to the special account for migrant workers’ wages as agreed, and the labor cost allocation period shall not exceed one month
.
Before the 7th of each month, the construction units of housing construction and municipal public works projects should allocate the labor cost no less than 20% and 15% of the project output value of last month to the special account for migrant workers’ wages
.
Article 13 [change of management personnel] during the implementation of the project, the project manager, technical responsible personnel, quality officer, safety officer, chief supervision engineer or director representative, professional supervision engineer and other personnel shall not change at will, and those who change or cancel without authorization shall be treated as breach of contract
.
Article 14 If it is necessary to change the personnel, the construction enterprise shall report to the supervision unit and the construction unit for written consent, and report to the competent department for filing
.
The supervision unit shall report to the construction unit for written approval and to the competent department for filing
.
The replaced person in charge of the construction project shall not participate in any project contracting for 150 consecutive days from the date of change to the date of project completion acceptance or from the date of change
.
The new supervision business can be contracted only after 30 days
.
Article 15 if the project really needs to change personnel, the following conditions shall be met: 1

In principle, the number of personnel to be changed in a project shall not be higher than 30% of the personnel in the organization of the letter of acceptance or the project personnel appointed in the tender documents or the number of personnel to be changed as agreed in the contract
.

The changed personnel shall be the personnel of the company and have the same professional qualification as the personnel before the change, and the professional qualification level shall not be lower than the professional qualification level of the personnel before the change
.
Article 16 [exit confirmation] the supervision unit shall submit the completion record on the platform, and the construction management personnel shall unbind the platform and leave the site with the consent of the construction unit
.
After the completion of the divisional and subdivisional works, the construction workers (migrant workers) can leave the site after the employer confirms that the construction workers (migrant workers) have paid and have no wages in arrears, and the employer approves.
